Apparel Industry Board, Inc. Release and Waiver of Liability
Assumption of Risk and Indemnity Agreement
In consideration for my participation in the “AIBI Fashion Lab” (the “Program”), and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I hereby agree as follows:
I acknowledge, agree and represent that I understand the nature of the Program, and that participation in the Program carries certain risks, including injury to my person and damage, theft or other loss to my merchandise. I am voluntarily participating in the Program with knowledge of the hazards involved and hereby agree to accept any and all risks associated therewith including, but not limited to, personal injury and damage to or loss of my merchandise.
In consideration for being permitted to participate in the Program, I hereby fully accept and assume all responsibility for any risks of loss, property damage, personal injury, bodily injury or death that may be sustained by me as a result of my participation in the Program.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed or infected by COVID-19 by participating in the Program and that such exposure may result in personal injury, illness, permanent disability or death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Program may result from the actions, omissions, or negligence of myself and/or others, including but not limited to, employees, volunteers, Program participants and guests. I also understand that due to governmental law, order or direction relating to COVID-19, the Program and my scheduled appointments may be cancelled or rescheduled.
I hereby release, waive, discharge and covenant not to sue Apparel Industry Board, Inc.,including any of its directors, officers, agents or employees, (“AIBI”), Apparel Industry Foundation, Inc, (“Foundation”), and Industrial Council of Nearwest Chicago (“ICNC”), and collectively with AIBI, Foundation, and ICNC the “Releasees”) from all liabilities, claims, demands, actions and causes of action whatsoever (including claims alleging releasee negligence) arising out of or related to any loss, damage or injury that may be sustained by me while participating in the Program or while on the premises where such Program is being conducted. I further release, waive, discharge, and covenant not to sue Releasees from any and all liabilities, claims, actions, damages, costs or expenses of any kind relating to COVID-19, including and/or arising out of participation in the Program or cancellation of the Program.
I further agree that if, despite this Agreement, I make or anyone acting or purporting to act on my behalf makes a claim against any of the Releasees, I will personally indemnify, save and hold harmless each of the Releasees from any litigation expense, attorneys’ fees, losses, liabilities, damages or costs which any of them may incur as a result of such claim.
This Agreement shall be construed in accordance with the laws of the State of Illinois.
I HAVE READ THIS AGREEMENT, I FULLY UNDERSTAND ITS TERMS, I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND I HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE. I INTEND THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE REMAINDER SHALL CONTINUE IN FULL FORCE AND EFFECT.
